Hi All,

Just thought you should know that the T&C have changed at DVD365, Movietrak and QFlicks:

Free trials are only available to new subscribers of the Qflicks service. Previous subscribers or trialists of Qflicks, DVDs365, Movietrak or Mailbox Movies, do not qualify for a free trial. Only one free trial may be redeemed per household and a free trial may not be combined with any other offer. You must have internet access and a valid credit/debit card to redeem a free trial offer. People who break this rule will be charged the monthly subscription without notice.

I currently have "free trials" with DVD365, Movietrak and QFlicks. I signed to these before the change in T&C but they have still billed me £44.97. I'm not happy about this at all as you can imagine. I am currently e mailing their accounts dept. on this and I'll let you know what happens. I've got a feeling it ain't gonna go my way because it also says that they have the right to change T&C at any time. What I'm not clear on is does this change my position. Any advice would be appreciated on this.

Cheers,

A

I believe a few msgs, probably Mr Admin, made people aware of such changes, and the merges and free trials situation many weeks ago on this forum, so if you've recently started their free trials, then I think you've lost out to be honest.. but if you feel you have an argument, then don't give up and hopefully you get some, if not all, of your money back.

Whether wrong or right, companies will take money whenever they can. Good luck with it all.. Confused

Hopeful you get your some if not all of money back.

As when you signed up I assume they didnt mention anything about any of the dvds365 sites.

But there t+c say they can change at anytime so dont know how much you can do. Confused

Idea Heres how you could argue possible by saying terms werent updated as last update date was made well before you signed up assuming you signed up to trials recently in last few weeks.

Print out all 3 terms and conditions now before this change is made.
If you read last line of which says last update date

movietrak - last updated 12 January 2005.
Qflicks - 15 December 2004.
DVDS365 - 29 October 2004.

Idea If you there taking long with your emails you may want to try calling 01333 429368 DVDs365 Customer services.

Big thanks for the replies guys. Some excellent advice from admin and big thanks for customer support number. They are not answering my e mails at all so looks like I'll have to phone. What really pisses me off is they don't even notify you that they will take any money. Also, it must be easy to set up a system whereby they tell you that you are not entitled to a free trail. Anyway I’ll let you know how it pans out.

Well I can't believe what they have done. They have changed the terms and conitions recently to cover Qflicks, Movietrak etc. but they haven't changed the last updated dates. So it gives the appearance that they were updated before they actually were. You only have to check the following threads to see this:

http://dvdtrials.co.uk/phpBB2/viewtopic.php?t=144

http://dvdtrials.co.uk/phpBB2/viewtopic.php?t=135

http://dvdtrials.co.uk/phpBB2/viewtopic.php?p=515&highlight=#515

I was very careful to double check T&C before signing up. I have copies of all T&C before they were changed.

I'll see what they've got to say first. Maybe it is a genuine mistake. I'll reserve judgement until I get an answer from them.

Cheers,

Show no mercy A ... any DVD's you get, scratch 'em all on return. Twisted Evil Anyway, in the end, just plead ignorant and hopefully they'll be understanding and give you some money back. Glad to see Mr Admin has helped. Good luck.

I'm not gonna go with them because they have a 20DVD limit/month and I have had 3 DVDs not arrive during trialing. Either they are not sending them or someone in the post office is getting some free viewing. It's a real pain.

Trouble is, the standards in general seems to be on the decline with most of the rental services and it does seem to vary variable with any one company. Difficult to decide who to give your hard earned to.

very mature .................

you do realise of course that it's not us you hurt by stupidity like that, it's other customers who may not get the film they want because you buggered it up. sure we have to pay for another DVD, but it's a tax write off.

thank goodness we're not all as childish as you ...........
