Fair enough, LoveFilm are now always pointing me to page 8 of the terms and conditions everytime I call up to tell them that the service isn't unlimited, as their tag-line states. But I was wondering how they stand legally on this.
When I signed up originally for LoveFilm over a year ago, the service was unlimited. This has obviously suddenly changed, and they have updated their terms and conditions accordingly to explain this the 'fair play' service.
Surely, they should inform all their customers of this by email, rather than LoveFilm firstly lying and blaming the postal service, then admitting the new service but only verbally over the phone.
I ticked and agreed to the original terms and conditions, but I've never seen the new ones.
I'm with Barclays bank and every now and then I get a new booklet from Barclays saying how their bank charges, service, conditions etc have changed - I'm sure you have to legally inform your customers in situations such as these.
What do you guys think?
I've had enough and going to move my business elsewhere, I just wanted to at least make them understand how badly they have treated their customers before I leave. On top of this, how they may have acted illegally. |

Heh I complained and got a pretty swift response!
I don't think this consitutes 'informing' me, but I don't know legally how this stands up.
Thank you for your email.
I can confirm that our updated terms & conditions have been checked &
verified by our soliciters. Our previous terms & conditions never
contained any information about how the service worked.
We informed our customers that the terms & conditions had changed via
the website, each link that took you to the terms & conditions had "new"
on it.
I am sorry that you feel this to be unfair.

Hate to say it, but they seem to have covered their ass so tightly, that there is no room for underwear.
From their site:
We may change these Terms and Conditions at any time. The Terms and Conditions applicable to your access to and use of this website will be the version that is current and displayed on the website as at each date you access the website. It is your responsibility to check the Terms and Conditions on each occasion that you access the website.
Basically......they can do what they like.....
They don't even care about angry customers who leave them. |
